I have read the FER and the cited art. D1 does not disclose the timing dependency in claim 1, and I would argue that as filed rather than concede it. D2 is closer, but only combines with hindsight.
On Section 3(k), I would bring the hardware limitation from claim 7 into claim 1. It is supported at page 11 and clears the objection without narrowing the scope that matters commercially.
I would keep a divisional open for the sensing subject matter. I will have a draft response with you by 20 October.
