PCT national phase entry in India: what to send, and what happens next
How a national phase instruction becomes a filed Indian application — the information required, the order of events, and where matters usually slip.

National phase entry is procedurally routine and operationally unforgiving. The application itself rarely causes difficulty; what causes difficulty is a missing declaration discovered a week before the deadline, or an instruction that was never converted into a docketed task.

What to send with the instruction
Send what you have. A complete package is not required to start — the gaps are identified on intake rather than at the deadline.
- The PCT publication or application reference
- Applicant details as they should appear on the Indian record
- Inventor details available to you
- Priority and bibliographic material
- Your client or matter reference, so reporting comes back in your structure
- Any known ownership, assignment or formalities issue

Where matters slip
Three failure modes account for most trouble. An execution document arrives late because nobody chased it early. A standing instruction — do not request examination yet, use this billing entity — is given once in an email thread and then forgotten by the time it matters. And a deadline is recorded but the preparation window in front of it is not, so the work starts too late to be done well.
All three are operational rather than legal. Each is why the deadline, the standing instruction and the preparation window are held on the docket rather than in an inbox.
Examination timing
Verify before publicationState the period within which examination must be requested, whether it runs from priority or filing, and the consequence of missing it. Confirm current practice on expedited examination and eligibility.
Many foreign applicants defer the examination request deliberately, for budget or portfolio reasons. That is a standing instruction rather than a one-off: it should be recorded against the matter and honoured without being restated each time.
